What is good sex? This question can be evaluated in multiple dimensions, the moral dimension being only one of them. My main thesis in this paper is that a criterion for good sex is whether the participants are on a par with each other. This can be understood as a moral ideal. In order to make this argument, I first explain what is meant by “sex”. This is, on the one hand, to delineate clearly which phenome-na are included in the (...) definition for the purposes of this argument. It is, on the other hand, to repel the problematic image of sex as something exclusively physical. In a second step I will address the issue of consent. Consent is, in my view, a minimal condition for the moral quality of sexual activities. It is only when consent is given by all participants that sexual activity is legitimized. Of course many related questions arise in this context, but without consent, we cannot speak of the moral quality of sexual activities at all. But why is consent so important? It is important to protect people. The protection is more successful if we take into account the attitude with which people engage with each other sexually. Sexual activities where people are on a par with each other are morally better than those where people are not. Being on par means that each participant’s desires and wishes are respected equally. I develop this thesis further by engaging with different objections. If we set out to question whether a sexual activity is morally good, we will also have to answer the question whether the participants who are engaged in this activity are on a par with each other. This paper considers how the United States does (and can better) ensure that members of the military accept moral responsibility for actions they perform in hostile and non-hostile situations. While the military education system offers soldiers a step-by-step approach to making ethical decisions, it is argued that this teaching is overly simplified as it fails to give enough guidance on how to choose an action that will best serve the nation. In addition to being able to recognize moral dilemmas, the (...) paper contends that understanding the basic principles behind Aristotle’s views on virtue ethics, Kant’s ideology concerning respect for persons, or Mill’s theory of utilitarianism could improve how soldiers go about making ethical decisions. Tracing different kinds of semiotic practices in boxing, in our text we provide a detailed reconstruction of the way athletes and other participants interpret each other’s actions and integrate these interpretations in their own course of motor action. Drawing on an ethnomethodological approach we argue that these interpretations should not be seen as being isolated from their contextual background. This context and the semiotic actions taking place within them mutually elaborate one another. Analyzing several video recordings and their transcripts, we (...) show how the social interaction of boxing fights consists of a “multi-layeredness of semiotic practice.” These layers of semiotic practice are complemented by what we introduce as asemiotic practices. Asemiotic practices exploit semiotic routines that are a part of boxing and attempt at weakening and overcoming the opponent during the fight thus eventually destroying his or her semiotic capacities. The concept of free will is fraught with controversy, as readers of this volume likely know. Philosophers disagree about what free will is, whether we have it, what mitigates or destroys it, and what it's good for. Indeed, philosophers even disagree about how to fix the referent of the term 'free will' for purposes of describing and exploring these disagreements. What one person considers a reasonably neutral working definition of 'free will' is often considered question-begging or otherwise misguided by another. (...) Such disputes make it difficult to summarize the problem of free will, roughly the debate over the nature and existence of free will, in a clear and uncontentious way. In generic terms, however, the two basic solutions to the problem of free will are free-willism, the view that we have free will, and free-will denialism, i.e. the view that we do not have free will. As stated here, neither denialism nor free-willism constitutes a complete solution to the problem of free will; to be complete, a proposed solution must also tell us a convincing story about what free will is and that, as it turns out, is a very difficult task indeed. One historically popular way of approaching the problem of free will is to ask about the relationship between free will and determinism: "Does free will stand in relation R to determinism: yes or no?" This is just a template for a question, of course. To transform this template-question into a substantive question with a clear meaning, we need to flesh out the template's free-will relatum, its determinism relatum, and give a precise value to relation R. There is, however, no uncontroversial way to do this. In addition to the standard difficulties raised by fixing the referent of 'free will', philosophers hold radically different views about what is-or should be-meant by 'determinism', Shabo ), and they identify relations which are as substantively different as correlation and causation when characterizing relation R. In practical terms, then, it may be best to think of the problem of determinism as a loose collection of disagreements about how to best spell out and answer the template-question, and how asking and answering such questions would help us to solve the problem of free will. Social norms – rules governing which behaviours are deemed appropriate or inappropriate within a given community – are typically taken to be uniquely human. Recently, this position has been challenged by a number of philosophers, cognitive scientists, and ethologists, who have suggested that social norms may also be found in certain non-human animal communities. Such claims have elicited considerable scepticism from norm cognition researchers, who doubt that any non-human animals possess the psychological capacities necessary for normative cognition. However, there is (...) little agreement among these researchers about what these psychological prerequisites are. This makes empirical study of animal social norms difficult, since it is not clear what we are looking for and thus what should count as behavioural evidence for the presence (or absence) of social norms in animals. To break this impasse, we offer an approach that moves beyond contested psychological criteria for social norms. This approach is inspired by the animal culture research program, which has made a similar shift away from heavily psychological definitions of ‘culture’ and to become organized around a cluster of more empirically tractable concepts of culture. Here, we propose an analogous set of constructs built around the core notion of a normative regularity, which we define as a socially maintained pattern of behavioural conformity within a community. We suggest methods for studying potential normative regularities in wild and captive primates. We also discuss the broader scientific and philosophical implications of this research program with respect to questions of human uniqueness, animal welfare and conservation. (shrink)

Scholars and professional organizations in bioethics describe various approaches to “quality assessment” in clinical ethics. Although much of this work represents significant contributions to the literature, it is not clear that there is a robust and shared understanding of what constitutes “quality” in clinical ethics, what activities should be measured when tracking clinical ethics work, and what metrics should be used when measuring those activities. Further, even the most robust quality assessment efforts to date are idiosyncratic, in that they represent (...) evaluation of single activities or domains of clinical ethics activities, or a range of activities at a single hospital or healthcare system. Countering this trend, in this article we propose a framework for moving beyond our current ways of understanding clinical ethics quality, toward comprehensive quality assessment. We first describe a way to conceptualize quality assessment as a process of measuring disparate, isolated work activities; then, we describe quality assessment in terms of tracking interconnected work activities holistically, across different levels of assessment. We conclude by inviting future efforts in quality improvement to adopt a comprehensive approach to quality assessment into their improvement practices, and offer recommendations for how the field might move in this direction. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Wedelstaedt überzeugend, warum Zustimmung zwar „die Bedingung für die Legitimation von Sex“ ist (2020, 127), dass die moralische Güte von Sex aber nur dann einzuschätzen ist, wenn wir darauf achten, ob die Beteiligten der Handlung sich auf Augenhöhe begegnen. Die Idee ist: Es gibt legitime sexuelle Handlungen, die moralisch gut sind, und es gibt legitime sexuelle Handlungen, die moralisch besser sind. Hier möchte ich die Idee des besseren Sexes genauer ausloten. (...) Während v. Wedelstaedt von moralisch gelungenem Sex spricht und somit auf der Ebene der moralischen Bewertung von Sex bleibt, möchte ich die Frage danach stellen, was Sex qualitativ gut macht. Tatsächlich wird in der Zustimmungsdebatte meist davon ausgegangen, dass diese zwei Fragen wenig gemeinsam haben; ob eine sexuelle Handlung legitim ist, hat zunächst nichts damit zu tun, ob diese auch gut ist. Ich werde drei Argumente liefern, warum wir legitimen Sex und qualitativ guten Sex zusammen betrachten sollten – und es wird sich zeigen, dass die gegenwärtige philosophische und rechtstheoretische Debatte Zustimmung verkürzt diskutiert und daher alleingenommen wenig hilfreich ist, stattdessen benötigt die Zustimmungsdebatte auch eine Untersuchung von qualitativ gutem Sex. Ereignet sich anstelle von Klang oder Sprache, Musik oder Lärm lediglich Stille oder vielmehr das, was wir für Stille halten, kommt ein unerwartetes Aufmerken in Gang. Die Stille kann auffordern, genauer hinzuhören, aber auch genauer hinzusehen. Ein plötzliches Aufmerken geschieht jedoch nur, wenn die Stille den Wahrnehmenden unerwartet trifft. Einer im Alltäglichen zumeist durch die Priorität des Bewussten, Bekannten oder Vertrauten untergeordneten Stille, können Arbeiten, wie jene von Aernout Mik, eine konkrete Erfahrbarkeit geben. Was er erfahrbar werden lässt, ist aber (...) nicht die Stille, sondern das, was in der Regel überhört wird. In der Verkehrung des vermeintlich Unhörbaren in ein Hörbares zeigt sich mit der Stille ein Möglichkeitsraum, dessen Besonderheit die Autorin mit der Frage, was sich in der Erfahrung von Stille zeigt, nachgeht. Ist also von einer Stille als ästhetischem Phänomen die Rede, ist nicht eine Stille innerhalb der Rezeption genuin stiller Kunstwerke gemeint, sondern der bewusste Entzug des Auditiven. Damit widerspricht die Autorin zugleich einer Vorstellung von Stille als mess- oder bestimmbarer Grösse und stellt die Stille aus der ästhetischen Erfahrung heraus ins Zentrum ihrer Betrachtungen. The terms ‘compatibilism’ and ‘incompatibilism’ were introduced in the mid-20th century to name conflicting views about the logical relationship between the thesis of determinism and the thesis that someone has free will. These technical terms were originally introduced within a specific research paradigm, the classical analytic paradigm. This paradigm is now in its final stages of degeneration and few free-will theorists still work within it (i.e. using its methods, granting its substantive background assumptions, etc.). This chapter discusses how the ambiguity (...) of the terms ‘incompatibilism’ and ‘compatibilism’ took root and why it matters to the contempory debate. I explain why the ambiguity of these anachronistic terms, though relatively innocuous when they were first introduced, is now encouraging theorists to tolerate and perpetuate serious philosophical errors (e.g. to conflate relations as different in kind and importance as correlation and causation, to knowingly promote invalid arguments, and to equivoate on jargon in ways that keep the free-will debate mired in psuedo-stalemates). Derk Pereboom's Four-Case Argument is among the most famous and resilient manipulation arguments against compatibilism. I contend that its resilience is not a function of the argument's soundness but, rather, the ill-gotten gain from an ambiguity in the description of the causal relations found in the argument's foundational case. I expose this crucial ambiguity and suggest that a dilemma faces anyone hoping to resolve it. After a thorough search for an interpretation which avoids both horns of this dilemma, I conclude (...) that none is available. Rather, every metaphysically coherent interpretation invites either a hard- or soft-line reply to Pereboom's argument. I then consider a recharacterization of the dilemma which seems to clear the way for the defence of a revised Four-Case Argument. I address this rejoinder by identifying a still more fundamental problem shared by all viable interpretations of the manipulation cases, showing that each involves a type of manipulation which undermines the victim's agency. Because this diagnosis supports a soft-line reply to every viable interpretation of the argument and can be endorsed by any compatibilist, I consider it the final piece of the Soft-line Solution to the Four-Case Argument. Finally, I suggest a new taxonomy of manipulation arguments, arguing that none that employs the suppressive variety of manipulation found in Pereboom's argument offers a threat to compatibilism. -/- (For direct download option, search Kristin M. Hermann Cohen’s essay on Maimonides’ ethics is one of the most fundamental texts of twentieth-century Jewish philosophy, correlating Platonic, prophetic, Maimonidean, and Kantian traditions. Almut Sh. Bruckstein provides the first English translation and her own extensive commentary on this landmark 1908 work, which inspired readings of medieval and rabbinic sources by Leo Strauss, Franz Rosenzweig, and Emmanuel Levinas. Cohen rejects the notion that we should try to understand texts of the past solely in the context of their own historical (...) era. Subverting the historical order, he interprets the ethical meanings of texts in the light of a future yet to be realized. He commits the entire Jewish tradition to a universal socialism prophetically inspired by ideals of humanity, peace, and universal justice. Through her own probing commentary on Cohen’s text, like the margin notes of a medieval treatise, Bruckstein performs the hermeneutical act that lies at the core of Cohen’s argument: she reads Jewish sources from a perspective that recognizes the interpretive act of commentary itself. Health is a value-laden concept. The state of being that it designates is a fundamental human goal. As a value, the concept is normative, governing both clinical practice and the therapeutic treatment developed by medical research. Also, the promise of health plays a pivotal role in health-policy discourse. Almut Caspary considers philosophical and theological concepts of health in the context of its practical significance, both in the past and today. This conceptual analysis culminates in a preliminary sketch of a (...) concept of health; focusing on the stem-cell debate, it offers a discriminating approach to contemporary ethical problems in medicine. "Gesundheit" ist ein wertgeladener Begriff. Er bezeichnet einen grundsatzlich wunschenswerten Zustand menschlicher Existenz, der das arztliche Handeln im klinischen Alltag leitet. Daruber hinaus werden (gesundheits-)politische Debatten mit Verweis auf den Nutzen fur die Gesundheit entschieden. Vor diesem Hintergrund setzt sich Almut Caspary epochenubergreifend mit philosophischen und theologischen Uberlegungen zur Gesundheit auseinander. Die konzeptuelle Diskussion erlaubt die Skizzierung eines Gesundheitsverstandnisses, das - wie am Beispiel der Stammzelldebatte gezeigt wird - ein differenziertes Abwagen in medizinethischen Konfliktfallen zulasst. The so-called quantum Zeno effect is essentially a consequence of the projection postulate for ideal measurements. To test the effect, Itanoet al. have performed an experiment on an ensemble of atoms where rapidly repeated level measurements were realized by means of short laser pulses. Using dynamical considerations, we give an explanation why the projection postulate can be applied in good approximation to such measurements. Corrections to ideal measurements are determined explicitly. This is used to discuss how far the experiment of (...) Itanoet al. can be considered as a test of the quantum Zeno effect. We also analyze a new possible experiment on a single atom where stochastic light and dark periods can be interpreted as manifestation of the quantum Zeno effect. We show that the measurement point of view gives a quick and intuitive understanding of experiments of the above type, although a finer analysis has to take the corrections into account. (shrink)

The strict distinction and separation of mind and body is a particularly modern Western point of view that is routinely also applied to other cultures. Arguing against this dichotomy, the following contribution builds upon research on "implicit knowledge" and "knowing how" that allow us to view body and mind in their interaction. The focus is on Simeon Stylites the Elder, the most prominent representative of the Syrian ascetic movement, who, in a spectacular way and after incessant exercise, was able to (...) act from a sphere of internalized body-knowledge. Selected texts on him dating from Late Antiquity will illustrate how the ascetic body was represented as a body of knowledge with which the idea of Christian perfection was to be fulfilled. (shrink)
